Terms Of Service

These terms and conditions (“Terms and Conditions”) govern the relationship between Escape Premium Travel, LLC and you, the purchaser or traveler. By planning travel with Escape Premium Travel, LLC, you agree to be bound by these terms and acknowledge that Escape Premium Travel, LLC, acts for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services.  These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to ESCAPE PREMIUM TRAVEL, LLC.

 

  1. USE OF ESCAPE PREMIUM TRAVEL, LLC SERVICES, ACCESS, AND INFORMATION FOR TRAVEL BOOKINGS
    1. You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with ESCAPE PREMIUM TRAVEL, LLC. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with ESCAPE PREMIUM TRAVEL, LLC and its Suppliers, and you acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.
    2. ESCAPE PREMIUM TRAVEL, LLC accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through ESCAPE PREMIUM TRAVEL, LLC, you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. You agree that you will abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. Requests cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider, not Escape Premium Travel. Conditions can change rapidly in a country at any time. It is your responsibility to check the USA Government Travel advisories for your intended destination at state.gov/content/travel.html.
    3. ESCAPE PREMIUM TRAVEL LLC is not liable or responsible for any arrangements made independently of ESCAPE PREMIUM TRAVEL, LLC. ESCAPE PREMIUM TRAVEL, LLC assumes no responsibility for costs or fees you incur for independent arrangements not booked through ESCAPE PREMIUM TRAVEL, LLC, inclusive of, but not limited to, airline, hotel, excursion, and travel protection related charges. If you make your own flight travel, ESCAPE PREMIUM TRAVEL, LLC is not responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates, and cannot assist you with any schedule changes or delays related to air reservations you have made on your own arrangement. It may not be possible to earn frequent flyer or other loyalty points for reservations on your itinerary. With limited exceptions, hotel and airline rewards or points cannot be redeemed for travel arrangements made by ESCAPE PREMIUM TRAVEL, LLC.
    4. Consultation Fees: There is no fee required to secure your appointment.
    5. Travel Agency Service Fees: ESCAPE PREMIUM TRAVEL LLC will charge the following non-refundable service fees on the following bookings:
      1. $100 per ticket on purchases for domestic air travel without hotel, cruise and/or tour;
      2. $150 per ticket on purchases for international air travel without hotel, cruise and tour;
      3. $100 per ticket on purchases for rail only tickets domestic and international; and/or
      4. **$100 exchange fee on air and rail only for any changes to a finalized booking.
      5. $100 for any cancellation or change of date, including the cost of change or cancellation from the vendor.

**The $100 exchange fee is in addition to any exchange fees that may occur by the airline or tour vendor and is non-refundable.

  1. ESCAPE PREMIUM TRAVEL LLC is registered as California Seller of Travel 2090937-50, Florida ST15578. Washington IBID No. 603189022. Registration as a travel seller does not constitute approval by the State of California.
  2. RIGHT TO CORRECT ERRORS AND OFFERS SUBJECT TO AVAILABILITY
    1. We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections.  All offers, incentives and Supplier promotions are subject to availability and may change without notice.  You are advised to confirm reservations in advance of your anticipated dates of travel to avoid issues with your travel reservation, as well as disappointment, increases in fares, and additional late booking fees.
    2. Pricing – IMPORTANT CONDITIONS: At the time we provide you with a quote, prices displayed are inclusive of all government and supplier taxes and/or fees for your booking and the total price will include any service fees charged (as more particularly described below). However, in some instances prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. U.S. or international government-imposed taxes and fees may apply on arrivals and departures depending on the itinerary chosen and are payable to the appropriate airport authority. By agreeing to these Terms, you expressly acknowledge your acceptance of these conditions (i.e., increases before full payment and increases attributable to government-imposed taxes or fees after full payment will be your responsibility) applicable to your purchase. Additional taxes and surcharges that cannot be pre-collected may be charged locally by car rental agencies, hotels or other suppliers. Most properties and vehicle rental/leasing companies require a credit card imprint at check-in.

 

  1. PAYMENTS, CANCELLATIONS, AND CHANGES TO BOOKINGS
    1. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through ESCAPE PREMIUM TRAVEL, LLC. By submitting a credit card authorization form to ESCAPE PREMIUM TRAVEL, LLC, you agree to allow ESCAPE PREMIUM TRAVEL, LLC to use your payment method to purchase travel product from our Suppliers on your behalf.  Except in case of fraud, you agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions of ESCAPE PREMIUM TRAVEL, LLC or its Suppliers, including cancellations or changes of the itinerary or arrangements for reasons beyond the control of ESCAPE PREMIUM TRAVEL, LLC or its suppliers.  If you attempt a chargeback, reverse or recollect a previously authorized trip payment, ESCAPE PREMIUM TRAVEL, LLC reserves the right to collect all additional costs, fees and expenses associated with such chargebacks, reversals, or recollection, including, without limitation, attorney fees.  Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking that you cancel, you agree to indemnify us for that fee or charge.
    2. You will be required to pay a minimum deposit of USD$150 or more per person when booking. The service provider may require further deposits. All deposits are non-refundable. Final payment is required no less than 60 days prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking. Escape Premium Travel accepts cash, checks, debit cards, or credit cards (AMEX, Visa, MasterCard, Discover or Diners). Should you wish us to charge your credit card, we may require you to read and sign a credit card charge form set out in the receipt. You agree that any fees charged by ESCAPE PREMIUM TRAVEL LLC are non-refundable, including without limitation the Consultation Fees, Service Fees and/or the Change Fee.
    3. Once a travel booking has been confirmed and deposit(s) and/or full payment are received, ESCAPE PREMIUM TRAVEL LLC reserves the right to charge a $100 non-refundable change fee ("Change Fee") for date changes made at your request for each adult travel booking changed. This Change Fee is in addition to any change fees charged by the travel service provider(s).
    4. Airline Refunds: You acknowledge that pursuant to the USA Department of Transportation Fine Rule on Refunds and Other Consumer Protections, from October 28th, 2024 (or such date as advised by the USA Department of Transportation) (“Final Rule”), you are entitled to a ticket refund for airline-initiated cancellation or significant change of flight itinerary (“Significant Change”).  A Significant Change is defined as including,
      1. Changes in departure or arrival times of at least 3 hours (domestic flights) or 6 hours (international flights) later than originally scheduled;
      2. Changes to scheduled departure or arrival airports;
      3. Increases in the number of connection points on a flight;
      4. Downgrades to class of services; or
      5. Certain changes adversely impact on passengers with disabilities.
  1. If a Significant Change occurs on your airline booking, you are entitled to a refund on your airline booking. The Applicable Refund must include all government-imposed taxes but does not include a refund for Consultation Fees, Service Fee, or Change Fee charged by ESCAPE PREMIUM TRAVEL LLC.  The Applicable Refund must be provided within 7 business days for credit card payments or 20 calendar days for other forms of payment.  An Applicable Refund is due by an airline directly in circumstances where you have paid the airline directly and indirectly for your booking.  In circumstances where ESCAPE PREMIUM TRAVEL LLC is the merchant of record for your airline booking, the Applicable Refund is only due to you once the airline confirms to us your eligibility for the Applicable Refund.  You acknowledge that in these circumstances, and pursuant to the Final Rule, we are unable to provide you with the Applicable Refund until we receive confirmation from the airline in writing of your eligibility.
  2. If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against Escape Premium Travel, and in the event that payment has been made to Escape Premium Travel by credit card, you agree that you will not seek to charge back your payment to Escape Premium Travel. If the credit card is passed through to the travel service provider and you seek to chargeback your payment from the provider, you agree to be held liable and indemnify Escape Premium Travel against this chargeback from the provider, including without limitation any air debit memos charged to Escape Premium Travel. If Escape Premium Travel incurs any costs, including but not limited to attorneys’ fees to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to Escape Premium Travel via money order or cash immediately.

 

  1. TRAVEL DOCUMENTS, INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS
    1. It is the responsibility of each Client to obtain and carry a valid passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel.  When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry acceptable identification to board a flight to a destination.  Acceptable identification can be found at TSA's Website and examples include DHS-designated enhanced driver’s license, U.S. passport, or a foreign government passport.
    2. Certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return. Non-United States citizens may require additional documentation, and you are responsible to make ESCAPE PREMIUM TRAVEL LLC aware when traveling on a passport from a country other than the United States of America.  ESCAPE PREMIUM Travel LLC neither controls nor warns of the issuance of visas or approval of visa waivers related to your travel.  Should a visa not be issued, ESCAPE PREMIUM TRAVEL LLC is not responsible for lost payments made toward your trip.  Please note that rules of each country regarding entry and exit may change at any time.
    3. Children and infants may also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not permitted entry, unless authenticated and verified consent forms are provided to the authorities; please see Customs and Border Protection for additional information.  The U.S. Customs and Border Protection Agency require that for groups of children under age 19 arriving to the United States by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate.  Parental or legal guardian consent must be provided to the supervising adult or group leader in writing.
    4. The name, date of birth, and gender that appear on the identification card must match the same data that is listed on your tickets and booking records. You acknowledge that it is your responsibility to ensure that the information on your tickets and confirmation is accurate.  Any discrepancy between your reservation and your travel documentation may result in denial of boarding or an undue delay at an airport security checkpoint causing delay in boarding your flight or missing your flight, and any subsequent scheduled travel bookings on cruises and tours.
    5. When you receive your travel documents, we always do our best to make sure your travel arrangements are satisfactory. However, it is your responsibility to review and verify all information for accuracy.  Contact ESCAPE PREMIUM TRAVEL LLC immediately if changes or corrections are required.  If you have not notified us of necessary corrections to your reservation within 24 hours of receiving your travel documents, ESCAPE PREMIUM TRAVEL LLC bears no responsibility for any additional costs associated with making necessary corrections.
    6. REAL ID: Beginning May 7th, 2025, (such other date as prescribed by U.S. Department of Homeland Security), if you plan to use your state-issued ID or driver’s license to fly within the U.S., it is your responsibility to make sure it is REAL ID compliant. If you are not sure if your ID/Driver’s License complies, please check with your local state department of motor vehicles, or visit TSA Real ID Website.  If you forget your state issued ID or your state issued ID is not part of Real-ID, TSA will confirm your identity at the airport at a cost of $45.  ESCAPE PREMIUM TRAVEL LLC does not pay or pre-pay this cost and must be collected at the airport by TSA.  If you have your passport, you may use your passport at no charge.
  2. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS
    1. Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country’s embassy directly for entry and exit requirements.  You can visit the U.S. State Department Website for further information about these requirements.  Visit Click Here for U.S. State Department.  We do not inquire about an individual’s criminal record in the interest of respecting our clients’ privacy.  For example, if you are traveling to or through Canada, individuals who have a prior history of Driving While Intoxicated (DWI) or with judgements for unpaid child support should review current entry requirements.  You could be denied boarding onto the cruise ship due to this prior history.  For more information go to Canada's website.
  3. IMMUNIZATIONS AND HEALTH SCREENINGS
    1. Some countries require you to have proper immunizations and health screenings and require you to have documentation of such immunizations and screenings before travel. ESCAPE PREMIUM TRAVEL, LLC shall not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon landing at your destination. In some cases, required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking.   4. RISK AND SAFETY
    1. Traveling to certain destinations may involve greater risk than others. ESCAPE PREMIUM TRAVEL, LLC urges Clients to remain informed daily as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on health and safety conditions in various countries and the level of risk associated with travel to international destinations can be found at State Department, TSA Website, Department of Transportation, Federal Aviation Administration, Centers for Disease Control, and Customs and Border Protection.
    2. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to Smart Traveler Enrollment Program
    3. BY OFFERING TRAVEL FOR SALE TO PARTICULAR DESTINATIONS, ESCAPE PREMIUM TRAVEL, LLC DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT’S OWN RISK.
    4. Activities that are included as part of itineraries that we book pose inherent risks and may be dangerous. Your itinerary may also involve travel to remote areas without access to medical facilities or treatment, changing weather conditions, interactions or encounters with wildlife, and other potentially dangerous conditions. By booking a trip with ESCAPE PREMIUM TRAVEL LLC, you acknowledge that you are aware that the physical exertion required to participate in certain activities can activate or aggravate pre-existing injuries, conditions, or congenital defects. You acknowledge that you should seek medical advice if you know or suspect that your physical condition may be incompatible with the activities on your itinerary. You may be required to wear approved safety equipment while participating in certain activities, and by booking travel with us and participating in these activities, you agree to use the recommended safety equipment and to ask questions if you are unsure about how to properly or safely use equipment.
    5. If you use, consume, or are under the influence of alcohol or illegal drugs prior to or while engaging in any activities on your itinerary, YOU ASSUME AND ACCEPT ALL RISKS, DANGERS, AND HAZARDS THAT MAY RESULT INCLUDING THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS, even in the event of negligence or fault by ESCAPE PREMIUM TRAVEL, LLC or third parties, and you indemnify ESCAPE PREMIUM TRAVEL, LLC from any and all liability for any damage to property or personal injury to any third party, resulting from your participation in the Activities, while, during, or after consumption of illegal drugs or alcohol.
    6. In the event of emergent health or safety concerns, once ESCAPE PREMIUM TRAVEL, LLC has investigated the prevailing situation, ESCAPE PREMIUM TRAVEL, LLC shall have the sole and absolute discretion whether to proceed with any ESCAPE PREMIUM TRAVEL, LLC escorted trip or private departure, or to make alterations to the itinerary.
  5. HAZARDOUS MATERIALS
    1. Federal law prohibits passengers from bringing hazardous materials on the aircraft.
    2. Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio-active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.
    3. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary.   6. INSECTICIDE NOTICE
    1. We recommend that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. This list is on the DOT’s website and is updated from time to time: S. DOT Aircraaft Disinsection Requirements.
  7. AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN
    1. Your airline ticket is a contract between you and the air carrier, even if you purchase through ESCAPE PREMIUM TRAVEL, LLC. If you purchase air travel through ESCAPE PREMIUM TRAVEL, LLC, you acknowledge and agree that ESCAPE PREMIUM TRAVEL, LLC does not have the right to control the operations of independent airlines, and agree that ESCAPE PREMIUM TRAVEL, LLC is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations.
    2. ESCAPE PREMIUM TRAVEL LLC shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only and may vary in price. Failure to make a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfare.
    3. Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.
    4. Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.
    5. Frequent Flyer mileage accrual is at the discretion of the airline(s). ESCAPE PREMIUM TRAVEL LLC has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status or certificates.
    6. Seat assignments are not guaranteed even after they are assigned, and ESCAPE PREMIUM TRAVEL, LLC has no control over airline seat assignments. Most airlines charge a fee to prebook a seat.
    7. Flights are booked based on availability at the time of reservation. Confirmation of flight bookings will be provided upon receipt of payment.
    8. The client must ensure that the accuracy of all personal details and flight information is provided at the time of booking. Any discrepancies should be communicated to ESCAPE PREMIUM TRAVEL LLC immediately.
    9. If there are any changes to the flight’s schedule (such as time changes, cancellations, or re-routing), the airline will notify the customer as soon as possible. The client should also use apps to assist them in their travels and keep them informed of any changes to their flight. Any additional costs arising from the change will be the responsibility of the customer.
    10. If the airline cancels the flight, the travel agency will work with the airline to offer rebooking, refunds, or compensation, but the agency is not liable for the airline’s actions.
    11. If a customer cancels their booking, the cancellation policy of the airline will apply. The agency may charge a service fee for processing the cancellation.
    12. Delays caused by the airline, weather, or other circumstances beyond the control of the travel agency are not the agency’s responsibility. The agency will assist with rebooking if needed.
    13. Compensation for delays will be subject to the airline’s policies and applicable laws, which vary by jurisdiction and flight type. S. Department of Transportation Airline Cancellation and Delay Dashboard
    14. The travel agency advises customers to follow the airline's baggage guidelines. The agency is not responsible for lost, damaged, or delayed luggage. Claims should be filed directly with the airline.
    15. Customers are encouraged to consider purchasing travel insurance to cover lost or damaged luggage.
    16. If a customer misses a flight or connection, they must notify the travel agency immediately. The agency will assist in rebooking, but additional fees may apply.
    17. The agency is not responsible for missing connections or flights caused by delays or other reasons outside their control.
    18. Refunds for flights are subject to the terms and conditions of the airline. The travel agency will assist in submitting refund claims but is not responsible for the processing time or decision of the airline.
    19. Tickets may be non-refundable or subject to penalties. It is the client’s responsibility to understand the airline’s refund policies before booking.
  8. LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE
    1. ESCAPE PREMIUM TRAVEL, LLC acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of ESCAPE PREMIUM TRAVEL, LLC. The Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and you consent to the use of those Suppliers.
    2. ESCAPE PREMIUM TRAVEL LLC is not responsible if a restaurant, tour operator, cruise line, or other service provider on your tour is unable to or fails to accommodate your dietary restrictions or requirements. ESCAPE PREMIUM TRAVEL LLC will ask the client about food allergies, and it is the client's responsibility to advise the travel agency of any allergies.  It is not the travel agency’s responsibility if the client does not advise the travel agency of food allergies.
    3. The Supplier may determine that alterations in itinerary are necessary for any number of reasons, including but not limited to severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and ESCAPE PREMIUM TRAVEL, LLC bears no responsibility for any changes.
    4. BECAUSE ESCAPE PREMIUM TRAVEL, LLC ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT ESCAPE PREMIUM TRAVEL, LLC IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. ESCAPE PREMIUM TRAVEL, LLC HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH ESCAPE PREMIUM TRAVEL, LLC, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE T0 DELIVER 0R THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR Cancellation AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF ESCAPE PREMIUM TRAVEL, LLC’S CONTROL, AND YOU HEREBY EXONERATE ESCAPE PREMIUM TRAVEL, LLC FROM ANY LIABILITY WITH RESPECT TO THE SAME.
    5. ESCAPE PREMIUM TRAVEL, LLC HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM ESCAPE PREMIUM TRAVEL, LLC WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY ESCAPE PREMIUM TRAVEL, LLC.
  9. FORCE MAJEURE
    1. ESCAPE PREMIUM TRAVEL, LLC will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of ESCAPE PREMIUM TRAVEL, LLC. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
    2. In addition, each of ESCAPE PREMIUM TRAVEL, LLC’s Suppliers have terms and conditions which include Force Majeure provisions. If a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you because of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier pursuant to their policies, although ESCAPE PREMIUM TRAVEL, LLC shall use its reasonable efforts to secure reimbursement for you where possible.
  10. CLIENT CONDUCT
    1. Each participant in any trip escorted by ESCAPE PREMIUM TRAVEL, LLC is expected to act responsibly and adhere to all behavior guidelines established by ESCAPE PREMIUM TRAVEL, LLC and our Suppliers, including adhering to dress codes at religious or cultural sites, or Supplier dress codes. ESCAPE PREMIUM TRAVEL, LLC and all local Suppliers reserve the right to remove you from any facility, hotel or resort property, tour location or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other clients on any element of your trip, or interferes with the operation or security of the places you visit. In any such case, there will be no refund.
    2. When you book travel with ESCAPE PREMIUM TRAVEL, LLC, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify ESCAPE PREMIUM TRAVEL, LLC for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip, or any portion of a trip. You agree not to hold ESCAPE PREMIUM TRAVEL, LLC or any of its related entities liable for any actions taken under these terms and conditions. Baggage and personal effects are always the sole responsibility of the client.
    3. Transportation, possession or use of illegal drugs will result in immediate termination of your trip and may result in prosecution by law enforcement authorities. You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over the counter drugs) for all countries and states you are visiting. Laws may require you to carry a prescription from your doctor.
  11. CURRENCY FLUCTUATIONS
    1. Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations.  ESCAPE PREMIUM TRAVEL LLC is not responsible for surcharges or foreign transaction fees imposed by clients’ credit card companies or banks.
  12. TRAVEL INSURANCE
    1. ESCAPE PREMIUM TRAVEL, LLC OFFERS ACCESS TO TRAVEL INSURANCE TO PROTECT PASSENGERS AND THEIR INVESTMENT IN TRAVEL. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF CLIENT’S ITINERARY TO PROTECT AGAINST THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, MISSED CONNECTION FOR CRUISES, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, JOB LOSS PROTECTION AND CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES.
    2. Without appropriate travel insurance, you understand and agree that if you cancel or interrupt your travel for any reason, portions of the trip/tour may not be refunded and ESCAPE PREMIUM TRAVEL, LLC’s and travel Suppliers’ cancellation penalties will apply resulting in the loss of monies up to the full cost of Client’s travel booking and related costs. The purchase of travel insurance is not required in order to purchase any other product or service offered by ESCAPE PREMIUM TRAVEL, LLC, however if you decline to purchase insurance, ESCAPE PREMIUM TRAVEL, LLC may require that you execute an insurance waiver. ESCAPE PREMIUM TRAVEL LLC is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. An additional charge applies for any travel insurance selected. It is your responsibility to know what your insurance policy covers, and to put alternative coverage in place, if you wish to ensure conditions that are excluded by your policy.
    3. ESCAPE PREMIUM TRAVEL, LLC CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE COVERAGE FOR A CLAIM MADE UNDER THE INSURER’S POLICY AND MAKES NO REPRESENTATIONS ABOUT THE EXTENT OF COVERAGE FOR ANY POLICY IT MAY OFFER OR QUOTE. ESCAPE PREMIUM TRAVEL ARE NOT INSURANCE AGENT’S AND WILL NOT GIVE OUT TRAVEL INSURANCE ADVICE ON WHAT WILL BE OR WILL NOT BE COVERED.
  13. RESERVATION OF RIGHTS AND CHANGES TO THESE TERMS
    1. We reserve the right to, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms and Conditions will be provided to Clients and will be posted on our website.  Upon posting, these terms and conditions will be effective immediately.
  14. GENERAL
    1. The laws of the State of Texas govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Collin, County, Texas in all disputes arising out of or relating to travel bookings with ESCAPE PREMIUM TRAVEL, LLC. Any claim against ESCAPE PREMIUM TRAVEL, LLC, must be made within 12 months of the date of the completion of the trip and not later. ESCAPE PREMIUM TRAVEL LLC shall not in any case be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages. You agree that you may only bring claims in your individual capacity and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. You expressly agree to waive and forego all rights to bring any such class actions, purported or proposed class actions, or representative actions.
    2. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
    3. These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and ESCAPE PREMIUM TRAVEL, LLC with respect to travel bookings made with ESCAPE PREMIUM TRAVEL, LLC by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and ESCAPE PREMIUM TRAVEL, LLC with respect to communications with ESCAPE PREMIUM TRAVEL, LLC. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
  15. HOTEL SERVICE FAILURES
    1. Maintenance Issues: Hotels usually state that if a maintenance issue arises (e.g., plumbing, heating/cooling problems), they will attempt to fix it promptly. The client will need to contact the front desk and speak to the employee.  If it is not resolved, ask to speak to the manager.  If the issue is still not resolved, the client should call ESCAPE PREMIUM TRAVEL LLC for assistance.
  16. NOISE AND DISTURBANCES
    1. If there are disturbances from other guests or external sources (construction or events), hotels often have guidelines for handling complaints. They may offer solutions like moving rooms, issue a partial refund, or provide a voucher for future stay if the issue is persistent.  Contact the hotel for information, as ESCAPE PREMIUM TRAVEL does not have the authority to speak for the hotel for compensation for clients.
    2. Hotels usually reserve the right to ask guests causing disturbances to leave the premises, though they might offer compensation if the problem is due to the hotel’s own management.
  17. Liability and Responsibility
    1. Most hotels have a disclaimer stating that they are not liable for certain issues outside of their control (natural disasters, power outages). They may limit their liability regarding personal property loss or damage unless caused by the hotel’s negligence.
    2. Guests are usually expected to respect hotel property and adhere to hotel rules. If the guest causes damage or violates the rules, they could be charged accordingly.
  18. Dispute Resolution
    1. Most hotels provide a process for escalating unresolved complaints. They might suggest first speaking to the front desk, followed by the manager or supervisor.  If the issue persists, the hotel may recommend reaching out to a customer service department.
    2. If the issue cannot be resolved directly with the hotel, some terms and conditions suggest involving third-party dispute resolution, such as contacting an online travel agency, customer service for bookings made through agencies, or a travel ombudsman.
  19. GOVERNING LAW:
    1. The construction, validity, and performance of these Terms and Conditions and any disputes between the parties shall be governed by and construed according to the laws of the State of Texas, without giving effect to its conflict of law principles, and any federal laws applicable therein. Both parties submit to the exclusive jurisdiction of the courts of the State of Texas, Collin County, Texas with respect to any legal proceedings relating to these Terms and Conditions.
